Law 268/1 October 2007 for the completion of art. 7 of Law 182/2002 on the Protection of Classified Information

The Parliament of Romania adopts the present law.

SINGLE ARTICLE

At article 7 of Law no.182/2002 on the protection of classified information, published in the Official Journal of Romania, Part I, no. 248 of 12 April 2002 , with the subsequent amendments, after paragraph (3), a new paragraph, paragraph (4), is inserted, stating the following:

"(4) Access to classified information that, under art. 15, letter d) and e), is considered state secret and restricted information is granted, provided that the election or the assignment were validated and the oath was confirmed for the following categories of persons:

•  the President of Romania

•  the prime-Minister

•  ministers

•  deputies

•  senators,

who, in conformity with their specific attributions, are authorized to have access to classified information without fulfilling the procedures stipulated under paragraphs (1) - (3) and under art. 28, based on particular internal procedures of the institutions they belong to, and confirmed by the National Registry Office for Classified Information, after they have been briefed on the responsibilities incumbent upon them regarding the protection of classified information and after they have signed the written non-disclosure agreement stipulated under art. 36, paragraph (3)."

This law was adopted by the Romanian Parliament under the terms of art. 77, paragraph (2), with the observance of the provisions of art. 75 and art. 76, paragraph (2) of the Constitution of Romania, republished.
